Terms and Conditions (T&Cs)

Offer
  Eligible Entrants who purchase a Participating Product from a Participating Retail Store during the Promotional Period and who submit an Eligible Entry will be eligible to receive the Cashback, subject to these T&Cs.
Eligible Entrants
  Australian residents aged 18 years and over, excluding the Excluded Entrants.
Excluded Entrants
  Employees of Samsung, a Participating Retail Store or any agency associated with this Offer and the immediate family of such employees. Participating Retail Stores and other distributors, retailers and resellers of the Participating Products are also Excluded Entrants.

  The definition of a Participating Product expressly excludes "C grade" or "seconds" products, second-hand, refurbished or demonstration products, and any costs, fees, expenses or liability of any description to pay any amount for installation, insurance, warranty or extended warranty, financing, delivery or any other cost which is, at the determination of Samsung in its absolute discretion, additional or ancillary to the models listed in the table above.

Cashback
  A cashback in the form of an electronic funds transfer ("EFT") to the Eligible Entrant's nominated Australian bank account to the value set out in the table above corresponding to the purchased Participating Product.
Eligible Entry
1. To be eligible to claim a Cashback, an Eligible Entrant must:
  1.1 purchase (by paying in full by cash, card or through a credit program offered by a Participating Retail Store where a proof of purchase is provided) a Participating Product from a Participating Retail Store during the Promotional Period (excluding any acquisition of a Participating Product via a rental arrangement);
  1.2 during the Redemption Period, visit www.samsung.com/au/tv-cashback, click on the Offer page ("Website"), follow the prompts to the online entry form ("Online Entry Form"), and:
    1.2.1 input the entrant's full name, phone number, email address and nominated bank account details (including Australian bank account name, BSB and account number);
    1.2.2 provide:
      (a) the model number of; and
      (b) a copy of the original tax invoice for,
        the Participating Product, and such other details as required by Samsung;
    1.2.3 subject to the paragraph 'Serial numbers and copies of tax invoices' below, provide the serial number, and a photo of the serial number, of the Participating Product; and
    1.2.4 submit the fully completed Online Entry Form during the Redemption Period,
      ("Eligible Entry").
2. Following submission of an Online Entry Form, the entrant will receive a unique entry reference number, which may be used to access the track entry page ("Track Claim Entry Page") on the Website.
  Entries may only be made by the actual purchaser of the Participating Products. Entries or registrations by any other person will not be accepted.

Serial numbers and copies of tax invoices
1. If an entrant is unable to provide the serial number and serial number photo of their Participating Product at the time of submitting the Online Entry Form, the entrant must still submit the Online Entry Form during the Redemption Period and tick the relevant box to indicate they have not yet received their Participating Product. The entrant must then provide Samsung with the serial number of their Participating Product within seven (7) days of receiving the Participating Product through that entrant's Track Claim Entry Page, so long as that serial number and serial number photo are provided on or before the Track Claim Entry Page Close Date. If the entrant does not receive their Participating Product(s) by the Track Entry Page Close Date (for reasons outside of their control) and cannot submit the serial number and serial number photo of the Participating Product by that time, the entrant should contact Samsung using the contact details provided below, and Samsung may permit the entry to proceed having regarding to all of the circumstances.
2. Samsung will validate all serial numbers and photos of serial numbers of Participating Products and the tax invoices submitted by entrants and will inform an entrant who has provided an invalid, serial number, and/or photo of the serial number and/or tax invoice by email. The entrant will have fourteen (14) days from the date of that email to provide a valid serial number, and/or photo of the serial number and/or tax invoice, as applicable.
EFT process
1. Samsung or its agent will review each entry and will confirm by email to each entrant whether or not their entry is an Eligible Entry.
2. EFT payments will only be made into Australian bank accounts. If an Eligible Entrant does not hold an Australian bank account, the Eligible Entrant should contact Samsung directly to discuss whether there are any potential alternative payment options. Samsung is not liable for any EFT payment not being made to, or received by, the Eligible Entrant because the Eligible Entrant does not hold an Australian bank account.
3. Eligible Entrants should allow thirty (30) days from the date their claim is deemed valid by Samsung or its agent for the EFT to be made to their nominated bank account, and may need to allow several days thereafter for the funds to clear.
4. If an Eligible Entrant becomes aware that they have submitted incorrect bank account information, the Eligible Entrant must immediately notify Samsung or its agent of the Eligible Entrant's error and provide correct bank account information. If an EFT is made to a bank account which was erroneously submitted by an Eligible Entrant, Samsung or its agent will attempt to reverse the EFT, which, if reversed, will be credited to Samsung or its agent, which will then make an EFT to the Eligible Entrant's resubmitted bank account. If an EFT is reversed and then retransferred because of an error of an Eligible Entrant's, a $7.95 bank re-issuing fee will be deducted from the amount of the Cash Back transferred to the Eligible Entrant's resubmitted bank account. Samsung or its agent does not warrant or represent that it will be able to effect an EFT reversal and Eligible Entrants agree that if they submit incorrect bank account information, and an EFT is paid to an incorrect bank account, the relevant EFT (and therefore, Cashback) may be forfeited.
5. Samsung may reclaim the Cashback from any Eligible Entrant if the purchased Participating Product is returned after the entry has been processed and fulfilled. This clause does not limit or affect the Eligible Entrant's rights in respect of warranties on the Participating Product.
Other matters
1. All references in these T&Cs to time are to the time in Sydney, NSW.
2. Participation in this Offer is deemed acceptance of these T&Cs.
3. This Offer is not valid in conjunction with any other offer or promotion.
4. This Offer is not open to companies, businesses, commercial ventures, organisations or anyone acting on their behalf.
5. Limit of one (1) Cashback per Participating Product purchased. Limit of three (3) claims per entrant.
6. All prices quoted in these T&Cs are inclusive of GST.
7. The Cashback is not transferable, exchangeable or redeemable for cash.
8. If this Offer is interfered with or cannot be conducted as planned, Samsung may disqualify any entrant and/or modify, suspend or terminate the Offer as applicable.
9. Any cost associated with accessing the Website for the purpose of registering an entry is each entrant's responsibility and is dependent on the internet service provider used. Samsung makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Offer or to receive the Cashback.
10. Samsung reserves the right, at any time, to verify the validity of claims and claimants (including a claimant's identity, age and place of residence, tax invoice photos or serial numbers) and to disqualify any claimant who submits a claim that is not in accordance with these T&Cs or who tampers with the claim process. All decisions of Samsung are final and no correspondence will be entered into. Failure by Samsung to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. The Promotional Period may be extended in Samsung's absolute discretion.
12. Except for liability which cannot be excluded as a matter of law, including the

  Samsung (or third parties on its behalf) may collect personal information to conduct the Offer and disclose such information to third parties for this purpose, including agents, contractors, service providers and offer suppliers. Validity of an eligible entry is conditional on providing this information. Some of these entities may be outside Australia, including in Singapore, Korea and the Philippines. Entrants acknowledge that by consenting to this disclosure, Samsung is not obliged to take reasonable steps to ensure overseas recipients do not breach Australian privacy law. All entrants consent to their personal information being collected and stored for this purpose in accordance with Samsung's privacy policy available at www.samsung.com/au, which forms part of these T&Cs.
